Kenton, DE - A man was arrested west of Kenton Nov. 28 after allegedly assaulting his girlfriend and their baby the day before.
The crime happened at a residence on Holstein Drive Nov. 27 between 6 p.m. and 11:16 p.m., according to Delaware State Police.
Jose A. Espinoza-Garcia, 25, was at home with his girlfriend, 34, and their one-year-old child, when Espinoza-Garcia became angry because the child was tugging at a computer cable. He struck the child with the cord, police said.
His girlfriend tried to protect their child, but Espinoza-Garcia punched her in the face.
Espinoza-Garcia then is alleged to have picked up the child and tossed the child at his girlfriend, resulting in the child suffering a bruise to her head. The girlfriend placed the child in a crib.
Espinoza-Garcia then grabbed his girlfriend and assaulted her, pulling on her hair, dragging her to a bedroom, choking her, and engaging in unwanted sexual actions, police said.
The girlfriend and the baby were treated at Bayhealth-Kent General Hospital for injuries sustained in the assault and were released.
On Nov. 28, State Police arrested Jose A. Espinoza-Garcia on charges of first-degree rape, second-degree assault, strangulation, second-degree unlawful imprisonment, third-degree assault, and endangering the welfare of a child. He was committed to James T. Vaughn Correctional Center on $80,500 secured bond to await another court appearance.
