I saw the USED in that first line and figured them to be just that. So... if they are not used condoms then there is no threat of spreading sexually transmitted diseases, right??

Ah, man what a waste. | Actually, the Snopes article does say that this is the second time, unused, recycled condoms have been used this way. In the first instance, there was no case of a used condom being turned into a hairband. In the current instance, "it is not clear" that any of the condoms had been used for their original intent and then turned into a hairband. If they had, they could certainly transmit disease.
The tone of the Snopes article seems to lead one to believe these are all unused condoms that were below specs and, thus, recycled. From the sources cited on the article, the first instances seems to have occurred in 2002, the second in November, 2007.
