Anyway, sorry to hear that. Get a lawyer, trust me. I wouldn't worry to much about the felony thing, he'll be charged as a juvenile and with a lawyer he can plead it down to probation and community service. Since it is his first offense, he's eligible to perform some tasks issued by the judge, community service, write an essay, get a part time job etc. After he does all that is required, his juvenile record will be expunged just as long as he doesn't get into anymore trouble again. I went through some stupid shit with my son too. (more serious)

All jokes aside, I am sorry. I feel your pain. Kids are scary. Even if you are with them 23 hours a day, they can screw up in the 24th hour! I cringed every time my boy went out, and yes, I always kept Joe Hurley's name in the back of my head (super secret- still do). Good luck.

What starts out as mischievous adventure spirals quickly into a potential felony when we come across all this cool stuff. Then we hear the cops, bust ass out of there, and talk giddily about it for the rest of the night.
Going back for the stuff isn't some mischievous "fun" that got out of hand.
It's a deliberate and premeditated plan to steal. It's purely criminal. No way to chalk that up to youthful hijinks.
If it had been me, and I was stupid enough to go back for the stuff, and got pinched, my whole story would have been:
"We saw some open units, decided to look around. We put together a pile of stuff and then heard the police and ran. After a while, we realized we had done wrong, and that the people wouldn't know where we hid their stuff. So we came back to put the stuff back where it came from before anybody even knew it was missing. Guess we should have just left it hidden."
I'd take it to the grave.
Edit: Of course, if the cops waited until we had a sack over our shoulder and were heading towards home...welllll | He's my son, but I have to agree. I also have since found out the other kid has a record, (a few years old), and has actually been sent to military school in the past. I always thought he was such a good kid, so polite, etc. I'm sure he was the mastermind on the whole damn thing, but guys have a habit of sticking together and not ratting eachother out so it's really hard to tell. Considering the other kid has a record, and everyone is totally freaked out who knows us thet my son would have ever done anything like this to begin with, I believe he was. It doesnt EXCUSE my son, but it does at least offer some insight into the idiocy. |

Good luck. | I cant even afford $1,500, and I'm not asking for a loan and I'm not working double shifts, etc etc. He's just going to have deal with he gets from the public defender. That's that. Like I said before, I have no guilt, I really, truly honestly have raised him to be far better than this, everyone knows it, all our family, all our friends and aquaintences, so, I just dont feel bad about not trying to scraoe up the money and not going into hock for it. I have managed to find a bit of sympathy, just the smallest amount, hardly registers, after finding out about the other kid and the conclusions I came to, but thats about it. I'm not afraid anymore, I know he's not going to prison.
As for beating him with a stick, as soon as we got home, I got my old trusty leather belt that he hasnt seen in a couple years, looked at it long and hard before walking out the door to do a couple laps around the parking lot. I wouldnt have been able to stop had I gotten started right then. |

He had an arraignment this past week. I have a bad habit of waiting until the last minute to do things, plus I was waiting for him to do this, call the public defender and set up an appointment. He kept saying "I dont know what to say!" to which I'd reply "Me neither, it's not like I've done this before!" to which he'd reply "Neither have I!", lol, I wasnt going to give in, but I finally did, he was scared, so I took pity and made the call myself the day before he was supposed to go.
The other kid had already been there, and the secretary who took our application said that it would be a conflict, the PD coulndt defend both kids at the same time, so one of the kids would have to get an attorny outside the PDs office. I have heard of this PD and he is really good they say, so I was a bit worried that my son wouldnt get him. Turns out, I'm glad he didnt. He got the private attorney, and this woman is a whirlwind, she's really good. First she tells him to plead not guilty, so she can do the leg work and look things over and see what kind of chance he has for a plea bargain, then asked us all sorts of questions about questioning, marinda rights and everything. I dont remember anything, it was 3 oclock in the morning. Anyway, our friend who was with us is a para-legal for a very big lawyer here and she used to work with our attorney and even she says she's really good. Maybe he has a chance to at least get some sort of punishment that will make him think, but not one that will ruin his life, now.
The state is paying for her services, but I am trying to find out if there is some way he can pay part of it back, I really think he should, he should learn how expensive it is to get in trouble, plus working folk shouldnt have to pay because my son made a dumb move. He's looking for a summer job now since he doesnt have to go back to court until May 12th. Anyway, thanks everyone for your support and kind words and 'wake-up' words, lol, which I needed to hear too. These guys want to move cases and are pretty decent. If he is not willing to make a sentencing reccomendation which you are willing to live with THEN plead not guilty and go for the lawyer.
