I agree with Py.
It IS a hard call to make.
Which is why the law makes it for us.
We can't try statutory rape cases on the basis of whether the minor "wanted it" or not.
Some do, some are prey.
Rather than have a court case centered on He Said/She Said...He Did This/She Did That...we cut to the chase.
Under 18 means hands off.

Perhaps a minor that is THAT close to being of age, that testifies on behalf of the accused, should have some bearing on the sentencing.

Former Del. Principal Pleads Guilty in Affair

GEORGETOWN, Del. (AP) - A former Sussex County high school principal has pleaded guilty to having repeated consensual sex with a 17-year-old student.
Dana Goodman was charged with fourth-degree rape, endangering the welfare of a child and official misconduct.
Delaware State Police began investigating the Sussex Central High School principal in May after the Indian River School District received an anonymous letter about the affair. According to court records, encounters between the principal and the student took place in Goodman's car and at motels in Laurel and Dover.
Goodman was to go on trial in two weeks, but instead pleaded guilty Wednesday.
He will be sentenced Nov. 14.
Goodman formerly lived in Easton, Md., but has moved to Melrose Park, Pa.

I suppose he WAS guilty of that, but if they've ruled it 'consensual' how can they also call it 'rape'?

He's been sentenced to 32 years with all but 4 years suspended.
