			<content:encoded><![CDATA[<div><font color="#000000"><span style="font-family: Verdana"><font color="#333333"><span style="font-family: SanSerif">REHOBOTH BEACH &#8212; A Rehoboth Beach resident is suing the city over new scooter regulations, saying an ordinance setting a $40 scooter parking permit is a violation of the Constitution.<br />
Lawrence Myslewski, 2 Dover St., has brought a class-action suit in U.S. District Court of Delaware alleging the new scooter permits violate the equal protection clause of the 14th Amendment because residents have to pay for a scooter parking permit, but not for a car or motorcycle permit.<br />
Myslewski, who owns two Vespa scooters, said in the suit that he cannot park his scooter in front of his home without paying for a permit. Myslewski referred questions to his attorney, David Finger, who said the scooter ordinance does not treat all motorists equally.<br />
The suit says the ordinance is discriminatory and does not relate to its stated goal of safe and effective scooter parking. The suit also says the ordinance does not address preventing scooters from riding or parking on sidewalks, which is already prohibited in the city code.<br />
&#8220;There is no basis to conclude that use of motor scooters results in any greater threat to public safety than any other form of motorized transportation such that different treatment is required,&#8221; the suit says.<br />
Finger is asking  the ordinance be declared unconstitutional and for judgment including costs and attorneys fees.<br />
Finger said he does not know how big the class is, since the suit was just filed. He did not have any timetable on when the case would be heard.<br />
The city approved its new scooter regulations March 15, which instituted a new scooter-parking permit fee and established scooter parking corrals around town.<br />

</a>May 18, 2013 -- 5:50am<font color="#232425"><span style="font-family: verdana"><span style="font-family: arial">Delaware recreational boaters have been asked to play a prominent role in helping to map future recreational Atlantic Ocean use by participating in the 2013 Mid-Atlantic VBoater Survey.</span><br />
<span style="font-family: arial">The survey is being conducted via the mid-Atlantic Regional Council on the Ocean to gain valuable and viable information about recreational boating activities throughout the region.</span><br />
<span style="font-family: arial">Over 5,000 invitations went out to boaters in Delaware earlier this week asking them to take part in the survey; information collected through the survey will be translated into maps and incorporated into MARCO&#8217;s online mapping tool to support ocean planning efforts in the region, including Delaware&#8217;s Atlantic waters.<br />

The Cleanup of the Inland Bays will be held on 2 Saturdays in June.  On June 8<sup>th</sup> the cleanup will be leave from Massey&#8217;s Landing Public Boat Ramp and clean up the Rehoboth Bay and Indian River Bay areas.  On June 22 the cleanup is focused on Little Assawoman Bay &#8211; volunteers should meet at Mulberry Landing Public Boat Ramp at the Assawoman Wildlife Area.  Dress to get dirty and wet walking conditions on land.  Rubber boots are suggested &#8211; and if you have lifejackets &#8211; bring one &#8211; as they&#8217;re required on the boats.  Last year 75 volunteers picked up 2650 pounds of debris.  <br />

<font color="#333333"><span style="font-family: SanSerif">Cape Water Taxi is about to launch its second season of providing beach-area residents and visitors an alternative way of commuting between beach locations, away from the overly congested streets. A second vessel, two new services and a third location will be introduced this season. Beginning Friday, May 17, Cape Water Taxi will operate on weekends only until it transitions into a full, seven-day-a-week schedule Friday, June 14.<br />
For this 2013 season, the fledgling business has added a second vessel, The Discovery, a 54-foot custom-built beauty. It features twin 150 HP engines, two restrooms and comfortable seating for 72 people. Also new for 2013, in addition to Water Taxi Service, Eco Tours and Sunset Cruises, passengers will be able to choose a new cruise called To the Bay and Back. Offered at 2 p.m. on weekdays, this will be a 2-hour cruise originating in Lewes. It will travel down the Lewes-Rehoboth Canal, into the Rehoboth Bay and then return to Lewes.<br />
 <br />
Also new this year will be a 90-minute Kid&#8217;s Camp out of Long Neck, offering children an opportunity to learn more about the inland waterways and try their hand at crabbing, line fishing and even casting a net to see what lies beneath the water&#8217;s surface. The Discovery will also be available for private charters for any type of celebration such as weddings, birthdays, graduations, promotions, or to just plain party.<br />
 <br />
2013 will offer residents and visitors to the Long Neck area, including The Peninsula, the opportunity to experience Eco Tours, Sunset Cruises and other fun trips aboard The Mummichog, a 35-foot tri-toon that seats 26 passengers comfortably. Cape Water Taxi will operate seven days a week with trips originating at Bayside&#8217;s Paradise Grill docks. Bayside is a Pot-Nets community on Long Neck Road.<br />

The spring schedule, May 17-June 13, will be an abbreviated Water Taxi schedule, operating on Friday evenings, Saturday and Sunday only from Lewes&#8217; Fisherman&#8217;s Wharf:<br />

</div><font color="#333333"><span style="font-family: SanSerif">An advocacy organization for surfers wants to ensure a prime East Coast surfing area is protected when officials replenish the beach north of Indian River Inlet.<br />
In a letter to the U.S. Army Corps of Engineers, officers of the Delaware Surfrider Chapter questioned requesting bids for the project during the public comment period, March 25 to April 10. &#8220;Such actions signal that the Army Corps will not consider anything said during the public comment period and that no information received during the comment period will change the project since it is going out to bid,&#8221; states the letter.<br />
The corps plans to dredge material from the bottom of Indian River Inlet and pump it onto the beach north of the inlet. A Delaware Department of Natural Resources and Environmental Control crew will use the dredged sand to rebuild the beach, which was severely damaged by storm surge and waves as Hurricane Sandy passed by the area in late October.<br />
The Surfrider Chapter has scheduled a meeting at 6:30 p.m. Tuesday, May 14, at the Lewes Public Library with DNREC officials to gather more information about the project. The organization supports the use of soft shoreline stabilization, including the addition of sand, provided all forms of recreation, wildlife and other natural resources are considered.<br />
&#8220;Surfing is an increasingly popular activity, and Indian River Inlet is one of only two areas in Delaware that is consistently surfable. Indian River Inlet should be managed in a way that accomplishes the mutual goals of protecting the roadway, while preserving or enhancing the beaches and surfing amenities and protecting fish and wildlife and the human uses associated with them,&#8221; the group commented.<br />
John Doerfler, vice chairman, said the organization questions the environmental assessment done as part of the project. They intend to bring those issues to the forefront during the May 14 meeting.<br />
The organization drew attention to the very first page of the assessment that listed Hurricane Sandy arriving on the East Coast in September, when it actually hit the area Oct. 29. &#8220;We find it amazing that such an incredibly important detail that has precipitated such a tremendous amount of work by the Army Corps could be wrong on a document like this,&#8221; states the letter.<br />
They urged officials to use fine-grained sand to rebuild the beach. &#8220;We believe there is a connection between the material selected for beachfill projects and the slope equilibrium that creates good surfing,&#8221; the group wrote.<br />
They said coarse sand creates a steeper beach profile and causes waves to break closer to the beach, while finer sand creates a flatter slope, waves breaking further offshore, which is ideal for surfing. The group is asking officials to allow Surfriders members to monitor beach conditions as work takes place.<br />
&#8220;Our newest concern is how quickly this funding was secured and how it has already been designated to replenish the dunes and beach without, from what we know of, much public comment or planning. The motto seems to be just dredge,&#8221; Doerfler said<br />

<font color="#333333"><span style="font-family: SanSerif">It’s ice cream tasting time again, when 21 new ice creams will vie between 1 and 7 p.m., Thursday, May 9, for a coveted place among The Ice Cream Store’s list of summer flavors - a list that includes some of the most unique award-winning flavors in the country.<br />
 <br />
Drawing nearly 1,000 people in 2012, The Ice Cream Store’s annual Ice Cream Social and Taste-Testing Contest is now a Rehoboth Beach spring tradition, and owner Chip Hearn is delighted.<br />
 <br />
With The Ice Cream Store praised as one of the top seven ice cream dipping stores in the country by Reader’s Digest, and named as home to one of the most inventive ice cream flavors in the country by Newsweek Magazine, Hearn - referred to as “ice cream maker extraordinaire” by the Associated Press - often finds he is competing against his own past victories as he keeps working to create the newest and most popular ice cream sensation. Still, year-to-year, his competitive spirit does not wane.<br />
 <br />
<b>How does he do it?</b><br />
Secreting himself away through the winter months - like a genius mad scientist - Hearn lets his imagination run wild, and concocts ice cream flavors.<br />
“I think like a kid,” Hearn said. “I take every incredible combination I can imagine putting together, and I try it - because I can! And sometimes it works really well!”<br />
 <br />
After months of trial and error, with many promising ideas falling by the wayside for reasons as varied as bananas compromising the texture of the ice cream or exotic flavorings being too difficult to obtain on the international market, 21 new flavors made the final cut to the 2013 Taste-Testing list. The fate of those flavors now rests in the hands of the public.<br />
 <br />
“I let the people decide,” Hearn explained. “They come, they taste ice cream all afternoon for free, and they vote for their favorites. Those are the ones we’ll continue making and add to our ice cream list for summer 2013.”<br />
Even more than their votes, Hearn says he enjoys people’s comments -and he listens. If the people say they wish a certain flavor had more chocolate ripples, he adds chocolate ripples; if they want nuts, he adds the nuts - a process that resulted in what Hearn believes will be two of this year’s most popular new flavors.<br />
 <br />
Taking 2012’s landslide first place winner, <i>Crack</i> - a Brown Shugah Vanilla ice cream base with pasteurized egg yolk, butter and sea salt, Hearn added a massive amount of cracked nuts (peanuts, cashews, almonds and pecans) to create <i>Crack These Big Nuts:</i> and added mini chocolate chips, brownie pieces, pecans, crushed Oreo cookie and a caramel swirl to create <i>This Ish Is Off The Hook.</i><br />
<b><b>The new taste-testing flavors of 2013</b></b><br /><br />Youngsters can look forward to a great time, as they are finally allowed to eat <i>Dirt - </i>milk chocolate ice cream with crushed Oreo cookies and cut up gummi worms, topped with a real worm. Also expected to join the list of children’s favorites are <i>Fruity Pebbles Ice Cream </i>and<i>Peeps Ice Cream.</i><br />

For the adventuresome with a sense of humor, Hearn’s offerings include <i>Breakfast in Bed</i> - African vanilla ice cream with pasteurized egg yolks, real maple syrup, and bacon; <i>Cornbread Ice Cream</i> - cake batter ice cream with superfine sugar and cornbread mix; <i>Chamomile Tea with Honey &amp; Lemon Ice Cream - </i>African Vanilla ice cream made with brewed chamomile tea; <i>Stifler’s Mom Ice Cream - </i>Brown Shugah vanilla ice cream with cayenne pepper powder, candied pecans and a caramel ribbon; and <i>What Would Jimmy Buffett Do? It’s 5 o’clock Somewhere - </i>African vanilla ice cream with cinnamon, Superfine sugar, salt, Nassau Valley red wine and Coca-Cola.<br />

			<content:encoded><![CDATA[<div><font color="#000000"><span style="font-family: arial">DEWEY BEACH, Del. - A local beach town is celebrating Cinco de Mayo, with a unique tradition. For the second year, Dewey Beach will host chihuahua and small dog races, along with a dog fashion show.<br />
The two events will be held at the Lifesaving Station on Dagsworthy Street, starting at 12 PM on Saturday May 4th. The fastest pup will be heading home with a $100 prize. The fashion show will take place on Sunday afternoon, at 12:00 PM.<br />
An entry fee of $20 is required for dogs planning to race, proceeds will be donated to Dewey Beach Patrol. Dogs must be registered with Dewey Beach to participate.<br />

			<content:encoded><![CDATA[<div><a href="http://wgmd.com/common/more.php?m=49&amp;post_id=30441" target="_blank"><font color="#232425"><span style="font-family: arial">The Attorney General&#8217;s Office tells WGMD that a criminal investigation conducted by its Special Investigations Unit has resulted in the arrest of a Bethany Beach police officer for assault. </span></font><br />
</a><font color="#232425"><span style="font-family: verdana"><span style="font-family: arial">The investigation was initiated by the Special Investigations Unit after a March incident involving a suspect in custody. The investigation revealed that Bethany Beach Police Lieutenant, 45-year-old Richard Haden, assaulted a suspect who was in custody at the department headquarters on March 3. </span><br />
<span style="font-family: arial">The Town cooperated fully in the Attorney General&#8217;s investigation; as a result of its investigation, the Attorney General&#8217;s Office secured an indictment Monday from the Sussex County Grand Jury charging Haden with one count of 3<sup>rd</sup> degree assault.</span><br />
<span style="font-family: arial">Haden turned himself in to Capitol Police in Georgetown Monday; he was released after posting $500 bail.</span><br />
<span style="font-family: arial">A case review hearing for him is scheduled for May 20.<br />
