<span style="font-family: arial">REPLENISH is a unique recycling program that collects food scraps from local restaurants in the Delaware resort region to be converted into nutrient-rich compost for local farms. Farms in turn grow better crops, including produce served by local restaurants; restaurants save on trash disposal costs; and landfill waste and greenhouse gas emissions are reduced for a healthier environment.</span><br />

</a><font color="#232425"><span style="font-family: verdana"><span style="font-family: arial">The agreement calls for Pauline Morse to plead guilty to three misdemeanor counts of endangering the welfare of a child and to cooperate with prosecutors and testify against Dr. Melvin Morse; Dr. Morse has pleaded NOT guilty to felony child endangerment and misdemeanor assault charges and he’s denied police claims that he may have been experimenting on the girl. Melvin Morse is set to go on trial June 10.</span><br />
<span style="font-family: arial">The Morse's were arrested after the child alleged that her step-father dragged her across a gravel driveway by her ankle last July and held her face under a running faucet at least four times since 2009, causing the water to go up her nose and all over her face while her mother stood by and did nothing to stop the abuse.</span><br />

Delaware State Police say 61-year old Alan Zihal, of Dover, dialed 911 because he was drunk and lonely.  </span></font><br />

Authorities say he called 911 three times from the Super 8 Motel in Harrington back in April.</span></font><br />
<font color="#555555"><span style="font-family: PT Sans"><br />
WBOC obtained a recording of one of those 911 calls.</span></font><br />

When the operator asks Zihal what is his emergency, his response is inaudible during the call that lasted less than one minute.</span></font><br />

Lieutenant Earl Brode tells WBOC, Zihal also asked the operator for cigarettes, alcohol and sexual favors.<br />

Dispatchers in the Kent County 911 center say non-emergency calls are a growing problem.<br />
It's a problem that Corporal Gary Fournier with Delaware State Police says ties up an operator from taking a life threatening call. <br />
     <br />
&quot;In that time spent where a person's life may be in danger or we need to get an ambulance or fire or police officer out to a location quickly, an operator may be tied up answering a call on some other non life-threatening or non-emergency call,&quot; said Fournier. <br />
<br />
Fournier says 911 is for emergencies only, but there are non-emergency numbers as well.<br />
<br />
&quot;We want to make sure that if people don't understand what the non-emergency numbers are you can call 911, but they're going to ask right away is it an emergency. Just make sure you say, 'No it's not an emergency,'&quot; said Fournier.<br />
<br />
Fournier also says a person can be fined up to $1,150 and spend up to six months in jail.<br />
<br />
The non-emergency number for Kent County is: 302-739-4863.<br />
In Sussex County, the non-emergency number is 302-855-2980.<br />
In New Castle County, the non-emergency number is 302-573-2800.<br />

			<content:encoded><![CDATA[<div><font color="#232425"><span style="font-family: verdana">Two men from New Jersey who brought a pickup  truck that was detailed with an image of the World Trade Center in New York and the names of police officers and firefighters who died in the 9/11 attacks to American Legion Post 28 nearly two years ago have been indicted on theft charges.<br />
66-year-old Mark Anthony Niemczyk of Tinton Falls and 41-year-old Thomas Scalgione of Manahawkin were indicted by a grand jury on May 3 on charges of third-degree conspiracy and theft by deception. Niemczyk has also been charged with third-degree failure to file a New Jersey personal income tax return in 2011. The New Jersey Office of the Attorney General says he failed to report thousands of dollars that he received from donations and merchandise sales in 9/11 events, as well as $55,000 in winnings at a casino in Atlantic City in September 2011.<br />
The indictment comes after an investigation that began in November of last year after the Attorney General's Division of Consumer Affairs referred the case to the Division of Criminal Justice Computer &amp; Financial Crimes Bureau. Under a judgement in favor of the Division of Consumer Affairs, Niemczyk and Scalgione must pay a total of over $200,000, which includes paying back donations, as well as paying penalties, attorney fees and investigative costs. Under the judgement, they're barred from every working for a charitable organization in New Jersey again.<br />
The indictment alleges that Niemczyk and Scalgione collected more than $50,000 that they claimed would go to 9/11 charities and victims' families. However, the Attorney General's Office says the men never gave any of that money to who they said they were going to give it to. In July 2011, the men brought the truck, a detailed red 2010 Ford F-150 that included the logos of the New York Police and Fire Departments, to Post 28 and put it on display. Legion members and residents came to see the truck and take pictures of it, and also buy merchandise. Niemczyk claimed to be a veteran of the Navy SEALs who served three tours of duty in Vietnam. He and Scalgione also claimed to be a father-and-son firefighters who were working at a firehouse near the World Trade Center. The AG's Office says they weren't registered with the state as a charitable organization, as required by state law.<br />
Both Niemczyk and Scalgione have admitted to multiple violations of New Jersey's Charities Registration and Investigation Act.<br />

<font color="#000000"><span style="font-family: arial">The state-of-the-art Indian River Inlet Bridge is quite impressive. Opened last January, it consists of four lanes as well as a pedestrian and bicycle walkway. But what it doesn't have are places to tie off booming equipment used to catch oil in the event of a spill.<br />
<font color="#ff0000">An average of two oil tankers carrying more than a million gallons of oil, travel through the Indian River Inlet on a daily basis, putting tidal wetlands, vegetation, bird populations, mammals and recreational resources all at risk. </font>That's where a yellow plastic lining called a boom comes in.<br />
&quot;It's a plastic float with a long piece of plastic that hangs below down the water,&quot; DNREC's Emergency Response Program Manager Ellen Malenfant said.<br />
Controlled by a boom vane, it maneuvers in a way that can collect and deflect oil coming through the Inlet. It's specifically designed to be used in areas like an inlet where there is a fast moving current.<br />
&quot;It's such a confined waterway, and it's a short distance across. You have all the water moving with the tide change coming in from the ocean to the back bays. It can be as fast as five knots, which is very quick,&quot; DNREC Senior Corporal Doug Messick said.<br />
The Coast Guard and DNREC believe this new method, is far more effective than traditional booming. Used successfully in areas out west and in Boston, officials are optimistic it will help protect the inland bays' resources.<br />
&quot;We think the concept works very well,&quot; President of Delaware Bay &amp; River Cooperative Rich Gaudiosi said.<br />
We're told crews are planning to test out the equipment a few more times before securing it as part of the area's contingency plan.<br />

Firefighters in New York City received an usual request: Rescue a cop stuck in a tree who'd been trying to rescue a cat.<br />
According to a hilarious account in the <a href="http://www.nypost.com/p/news/local/queens/fdny_rescues_cop_stuck_in_tree_saving_BQCXm5nse6tvaNquzDEkqJ" target="_blank">New York Post</a>, New York&#8217;s finest spent about 30 minutes to right a rescue gone embarrassingly wrong.<br />
First, the New York Police Department responded to 911 phone calls from local residents in Queens who noticed a feline high up in a tree across from Public School 213, which was letting out.<br />
Veteran Police Officer Dane Natto and his partner arrived on the scene, and Natto tackled the tree, climbing up to get the cat. But the cat saw the cop coming and climbed higher, as did Natto. Finally, the officer admitted defeat. He then realized that he, too, was stuck in the tree&#8212;some 30 feet off the ground.<br />
A <a href="http://gawker.com/firefighters-rescue-cop-stuck-in-tree-trying-to-save-ca-505488908" target="_blank">growing audience</a>, including elementary schoolkids from PS 213, watched the fiasco unfold.<br />
&#8220;We looked out the window, and we saw the cop inside the tree&#8212;sitting,&#8221; Luna Giuong told the Post. &#8220;[His] partner was laughing at him.&quot;<br />
He stopped laughing long enough to call the New York Fire Department, which, writes the Post, &#8220;couldn&#8217;t believe what they were hearing.&#8221;<br />
When the NYFD arrived, &#8220;they didn&#8217;t go straight to helping him,&#8221; Giuong recalled. &#8220;They all gathered around and laughed at him. They took their time.&quot;<br />
Finally, using a ladder to climb the tree (the right way to <a href="http://www.ehow.com/how_117308_cat-tree.html" target="_blank">rescue a cat</a>, by the way), firefighters got the feline. Then Natto used the ladder to climb down. His descent was greeted with applause from the crowd.<br />
The rescue took about 30 minutes, but, unfortunately for Natto, that cat tale will probably last a lifetime.<br />

Cape Henlopen voters in Area A returned Noble Prettyman to the school board.  He topped Alisha Broughton 311 votes to 259.  In the Indian River School Board election for District 3 Leolga Wright easily defeated challenger Paulette Rappa 578 votes to 119.  Seaford voters returned Rebecca Adams for a 1 year term.  She received 370 votes to Jeffrey Benson&#8217;s 203, however for the 5-year seat David Tull was the top vote getter &#8211; receiving 176 votes.  Jerry Semper got 164, incumbent Clinton Dunn received 149 and Andrew Cannon got 107.  Walter Rudy returns for another 5-year term in the Woodbridge School District.  He got 112 votes to Darrynn Harris&#8217;s 19.</span></font><br />
<font color="#232425"><span style="font-family: verdana">In the Milford School District in Kent County,  there were six candidates vying for the 1 open at-large seat on the Milford School Board, which was vacated by Paul Faulkner.  Hunter Emory was the top vote-getter with 201 votes.  He was followed by Natalie Shockley with 142.  Kevin Marshall received 91 votes, Michael Wells got 56, Alan Southard got 34 and Robert Vincelette received 8 votes for the 5-year term.   Sharon Kirby ran unopposed for the Area A seat after Herman Cohee stepped down. <br />

The state House today passed Senate Bill 16, which requires owners of lost or stolen handguns to report that loss or theft within a week of discovering the weapon missing. The vote was 22 to 19 to approve SB 16.  Delaware will become the 8<sup>th</sup> state to require the reporting of lost or stolen fireams.  Governor Markell intends to sign the bill in the near future. <br />

Newark police said Sunday they were investigating a stabbing which took place at 1:20 a.m. Sunday morning in the parking lot at 54 East Delaware Avenue, which is located behind the Main Street Galleria.<br />
<br />
Police say they learned of an argument between the victim and suspect which led to a fight, leading to multiple stab wounds to the chest and abdomen. Police would only identify the victim as a 22-year-old UD student, which matches Sasek. They also said the victim underwent surgery and was listed in stable condition.<br />
<br />

A 17 page lawsuit has been filed in Kent County and alleges repeated sexual assault of a teen who Phillips encouraged to get involved with politics.   The lawsuit says that after she turned 18 Phillips forced her to have sex several times in a variety of locations in 2011 &#8211; threatening her not to tell anyone.  The lawsuit includes graphic detail about alleged bondage, use of sex toys and threats.<br />
Calls to Phillips go straight to voice mail and have not been returned.  Sussex County Government spokesman Chip Guy says this is a personal matter that has nothing to do with Phillips&#8217;s official capacity with the county.<br />

<font color="#555555"><span style="font-family: PT Sans">The Senate already approved the changes which would increase Delaware's minimum wage to $8.25 by January 2015.</span></font><br />
<font color="#555555"><span style="font-family: PT Sans">Business owners in Sussex County are divided over whether or not the increase is good for small businesses.</span></font><br />
<font color="#555555"><span style="font-family: PT Sans">&quot;$8.25 seems like a lot to start someone who has no experience, if it was $8.25 I'd have to think twice about hiring another person,&quot; said business owner Jeff Clayton.</span></font><br />
<font color="#555555"><span style="font-family: PT Sans">But Tracey Rossetto, owner of Critter Beach says a higher wage is needed to keep good employees.</span></font><br />
<font color="#555555"><span style="font-family: PT Sans">&quot;There's no reason to have every summer come by and hire different people,&quot;he said. &quot;If I were to not pay my employees well, they're gonna leave and go find work elsewhere.&quot;</span></font><br />
<font color="#555555"><span style="font-family: PT Sans">If the General Assembly approves the changes to Delaware's minimum wage the first change would go into effect in January. Minimum wage would go up to $7.75 from the current of $7.25. It would then go up again to $8.25 in January of 2015.<br />

			<content:encoded><![CDATA[<div><font color="#000000"><span style="font-family: arial">DOVER, Del. - Dangerous, violent criminals would face tougher bail conditions under legislation that passed unanimously in the Senate on Wednesday.  The the bail reform legislation now goes to Governor Markell, a strong supporter, to sign.  The bill passed the House unanimously on March 28.<br />
The measure requires that defendants who are arrested for a violent felony, while out on bail for a previous offense, have their bail for the first offense revoked if a Superior Court judge decides there is sufficient evidence that the person committed the later crime.<br />
The repeat offender would forfeit the bail if it was <i>cash</i> and a hearing would be held to set a new bail amount.   Under the legislation, that amount must be reset to at least double the initial amount.<br />
The legislation sets the presumption that cash bail be imposed for persons charged with a violent felony involving a firearm.  In addition, it makes clear that the Court must require a defendant to appear at court when summoned.  Having this requirement as a clear condition of bail will allow the bail to be forfeited if the defendant does not appear for trial or other proceedings.<br />

US Attorney for Delaware, Charles Oberly says 45 year old Joseph Terranova before Judge Gregory Sleet.  Terranova was a Vice President/Division Manager of the Delaware Commercial Real Estate Division of Wilmington Trust Company.  Officials says he conspired to extend credit to customers of the bank under terms inconsistent with those approved by the bank &#8211; including loans to Dover developer Michael Zimmerman.  Terranova faces up to 5 years in prison and a $250,000 fine.<br />

Is it me?  I see all these families of Newtown victims trotted out into the spotlight and all I can think about is opportunists.  These parents, convinced and talked into how wonderful it would be if others were allowed, in their time of greiving, sent off around the country and talking about gun violence.  I see it as parents trying to get their 15 minutes of fame or some politico or PR firm that is trying to push their agenda.  I just don't see this as anything other then the opportunist angle.</div>

Officials say dozens of victims &#8211; homeowners, companies and the federal government &#8211; were defrauded.  The indictment stems from a 3-month investigation that began with a complaint that a homeowner paid John Walsh of Millsboro for work that his company never did.  Seven people associated with 51 year old John Walsh and his various heating and air conditioning services companies were indicted on charges of theft and fraud and other offenses over a four-year period that began in 2009.</span></font><br />
